(1) A person is exempt from sections 18-18-425 to 18-18-430 if the person is: (a) Participating as an employee, volunteer, or participant in an approved syringe exchange program created pursuant to section 25-1-520; or (b) A pharmacist or pharmacy technician who sells nonprescription syringes or needles pursuant to section 12-280-123 (4). (c) Using equipment, products, or materials in compliance with section 18-18-434, article 170 of title 12, or article 50 of title 44. The manufacture, possession, and distribution of such equipment, products, or materials is authorized within the meaning of 21 U.S.C. 863 sec. (f).
