Sec. 1. A person who knowingly or intentionally: (1) possesses; (2) manufactures; (3) places; (4) disseminates; or (5) detonates; a weapon of mass destruction with the intent to carry out terrorism commits a Level 3 felony. However, the offense is a Level 1 felony if the conduct results in serious bodily injury or death of any person.
