Sec. 1.1. (a) As used in this section, "dangerous device" means: (1) a firearm; (2) a destructive device (as defined in IC 35-47.5-2-4 ); or (3) a weapon of mass destruction ( IC 35-31.5-2-354 ). (b) A person who checks an item to be transported on a commercial passenger airline and who: (1) knows the item contains a dangerous device; and (2) knowingly or intentionally fails to disclose orally or in writing to the person to whom possession of the item is delivered for carriage that the item contains a dangerous device; commits undisclosed transport of a dangerous device, a Class A misdemeanor.
