(1) Terms defined in Sections 58-37-101, 76-1-101.5, 76-18-101, and 76-18-201 apply to this section. (2) An actor commits unlawful failure to use original controlled substance container if the actor: (2)(a)(i) is an individual to whom, or for whose use, a controlled substance has been prescribed, sold, or dispensed by a practitioner; or (2)(a)(ii) is the owner of an animal for which a controlled substance has been prescribed, sold, or dispensed by a veterinarian; and (2)(b) possesses the controlled substance in a manner other than in the container in which the controlled substance was delivered to the actor by the person selling or dispensing the controlled substance. (3) A violation of Subsection (2) is a class B misdemeanor. (4) It is a defense to a prosecution under this section if the actor produces in court a valid prescription for the controlled substance or the original container with the label attached.
