(1)(a) As used in this section, "device" means the same as that term is defined in 78B-6-2601. (1)(b) Terms defined in Sections 76-1-101.5, 76-5c-101, and 76-5c-201 apply to this section. (2) An actor commits deactivation of a pornography device filter on a minor's device if the actor: (2)(a) is 18 years old or older; (2)(b) intentionally disables the filter required under Section 78B-6-2602 that is on a device in the possession of a minor; (2)(c) disabled the filter for the purpose of disseminating pornography to the minor described in Subsection (2)(b); and (2)(d) is not the parent or legal guardian of the minor described in Subsection (2)(b). (3)(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a class A misdemeanor subject to a fine of not more than $2,500. (3)(b) A violation of Subsection (2) is a third degree felony subject to a fine of not more than $5,000 if the actor has previously been convicted of a violation of Subsection (2).
