As used in this part: (1) "Incompetent to be executed" means that, due to a mental condition, the individual sentenced to death lacks a rational understanding that the individual is to be executed as punishment for the individual's commission of the crime of murder. (2) "Sentencing court" means the court in which the sentence of death was rendered.
