Va. Code Ann. § 19.2-321Primary source, current through the 2026 Regular Session

A. The petition to the Court of Appeals shall be filed with the Clerk of the Court in the manner and within the time provided by law. B. The petition in a case wherein a writ of error lies from the Supreme Court shall be filed with the Clerk of that Court in the manner and within the time provided by law.
